If you are getting ready to lease property for commercial purposes for the first time, you will want to download a commercial lease agreement template from the Internet. A template varies from a form, in that the template contains all the necessary information and files for you to create your own individualized form from the template you have downloaded.
When using a commercial lease agreement template you will need to change a lot of the information on the template to make it suit the purpose for which you intend it. This is very important as a lease agreement is legally binding in a court of law and must contain all the important rules of the lease that you want in it. A verbal agreement is not enough when it comes to letting your tenant know what you want, if it is not in the lease chances are good that if it goes to court the tenant will win as the burden of proof shifts to you.
If you only have a generic commercial lease agreement then if you have other elements that you need to add to the agreement you will be unable to do so. It is advised that you download a commercial lease agreement template and make the changes you need before presenting the agreement to your prospective tenant. This way all the various elements of the agreement are in place before you both sign.
Be sure that your agreement has all the basics in it including the address of the property, the length of the lease, the names of all parties involved, including any third parties, the amount and frequency of payment, and any provisions to the lease you wish to make. Your lease should also include the time that the lease will terminate this time is up to you, but keep in mind that if you offer a long term lease that it is also within your rights to put provisions in your lease for increases in monthly rent that will cover cost of rising fees over the life of the lease.
Once you have everything in your commercial lease agreement template that you want to include read it over one last time to be sure that there is not something that you missed. Missing elements can be very expensive to the property owner should anything ever need to go to court. Once you are sure that your lease agreement is complete print it out and take it to your tenant to be signed.
